The Futon Shop Rewards

THE FUTON SHOP REWARDS PROGRAM TERMS & CONDITIONS

1. Eligible Participants. An "Eligible Participant" means an The Futon Shop user who meets, and continues to meet during participation in the Program, the following criteria:

  • 1. Is a registered member of www.thefutonshop.com with a Futon Shop account in good standing (no hold or suspension) and is a legal U.S. citizen 18 years of age or older with a U.S. registration address tied to his/her The Futon Shop account;
  • 2. Accepts these Terms and Conditions and has not opted out of the Program.
  • 3. Receives confirmation of registration in the Program from The Futon Shop (via confirmation page in the Program registration process); and
  • 4. Has not been previously terminated from participation in the Program by The Futon Shop.

2. Qualifying Spend. "Qualifying Spend" means payment made for items purchased by Eligible Participants that meet the following criteria:

  • 1. They were purchased after Program registration on www.thefutonshop.com.
  • 2. Excludes sales tax, shipping charges, discounts, partial refunds, free items, items that fail to comply with applicable The Futon Shop terms and conditions, past purchases, and non-shipped, undeliverable or returned items; and
  • 3. For returned or otherwise refunded items, The Futon Shop will reduce an Eligible Participant's Rewards balance in any Reward Period (even if the item was returned or refunded after the Eligible Participant already redeemed Rewards for such item) and this may result in a negative Rewards balance. The Futon Shop reserves the right to place a hold or suspend an Eligible Participant's The Futon Shop membership account in the Program if a negative Rewards balance is not reversed within 90 days.

3. The Futon Shop Rewards Period and Reward Points

  • 1. "Rewards Period" means the applicable calendar quarter (90-day period) during which The Futon Shop offers to an Eligible Participant the opportunity to accrue Rewards (defined below).
  • 2. "The Futon Shop Rewards Points" means the unit by which The Futon Shop measures an Eligible Participant's earn on Qualifying Spend. The Futon Shop Rewards Points have no cash value and cannot be redeemed for cash or its equivalents.

4. Rewards. "Rewards" means a U.S. dollar amount which will be given in the form of Futon Shop Rewards Points attributed to the Eligible Participant's The Futon Shop account and meets the following criteria:

  • 1. Reward amount will be comprised of the base earn which is calculated as a percentage of Qualifying Spend plus any limited-time promotional offer(s) that The Futon Shop, in its sole discretion, may offer to Eligible Participants;
  • 2. If The Futon Shop offers to an Eligible Participant multiple limited-time promotional offers for Rewards at any given time, that Eligible Participant will receive the promotional offer resulting in the highest Reward as calculated by The Futon Shop but limited-time promotional offers for Rewards may not be stacked or combined;
  • 3. An Eligible Participant can earn up to US$1000 value in Rewards Points for each Reward Period, regardless of the number of items purchased in that quarter
  • 4. Over the course of each Reward Period, Rewards Points are capped at 5000 for each Eligible Participant;
  • 5. Rewards may only be earned on one The Futon Shop account per Eligible Participant, regardless of the number of The Futon Shop accounts used by such Eligible Participant;
  • 6. Rewards will be tied to the The Futon Shop account of the Eligible Participant and Rewards cannot be combined across any other The Futon Shop accounts;
  • 7. Unused Rewards Points on The Futon Shop Rewards Program are forfeited when The Futon Shop Reward Period Expires;
  • 8. The Futon Shop reserves the right to hold back or otherwise suspend Rewards after purchase in its sole discretion to investigate compliance with The Futon Shop's policies. In such case, Rewards may not post for Qualifying Spend during The Futon Shop's investigation and will post if The Futon Shop clears the transaction; and
  • 9. The Futon Shop reserves the right to fix any processing errors it discovers, which may result in adjustments to Rewards after posting.
  • 10. Rewards Points used for an item that is later returned will be forfeit.

5. Reward Redemption. An Eligible Participant may redeem Rewards in accordance with the following requirements:

  • 1. Rewards may only be redeemed toward purchases made on www.thefutonshop.com;
  • 2. Effective January 1, 2017, Rewards may not be redeemed for Futon Shop Gift Cards or Futon Shop Gift Certificates.
  • 3. To use The Futon Shop Rewards Points, the Eligible Participant must select an item into their shopping cart and select the amount of points they wish to apply to particular transaction.
  • 4. The dollar value of the Rewards Points will deducted from the total purchase price and any unused Reward amount remaining on The Futon Shop Rewards Account will continue to be available to the Eligible Participant until the Futon Shop Reward Period expires;
  • 5. Any unused amount on The Futon Shop Rewards Program shall be forfeited if not redeemed before the expiration date;
  • 6. Rewards are not transferable and have no face value;
  • 7. Rewards may not be redeemable through some customized checkout systems;
  • 8. Rewards cannot be used retroactively for prior purchases;
  • 9. Rewards cannot be redeemed for cash, but The Futon Shop reserves the right to give Rewards in the form of cash in its sole discretion;
  • 10. Unredeemed Rewards Points are forfeited if the Eligible Participant opts out of the Program or if The Futon Shop terminates the Program or the Eligible Participant's participation in this Program; and
  • 11. If an Eligible Participant uses the The Futon Shop Rewards Points towards the purchase of an item that is later refunded, the Eligible Participant the will forfeit used Rewards Points.
  • 12. An Eligible Participant may use a minimum of 50 and a maximum of 500 Rewards Point per transaction per day.

6. Other Terms and Conditions.

  • 1. Modification and Termination.
    • 1. The Futon Shop reserves the right to modify or terminate this Program at any time by posting amended terms or a termination notice on the Eligible Participant's Futon Shop Dashboard section within My Account or by sending email notice to the email addresses tied to Eligible Participants' The Futon Shop accounts. Except where stated otherwise, all amended terms will be effective three (3) days after they are posted and/or emailed to you. Without limiting the foregoing, The Futon Shop may suspend an Eligible Participant's participation in the Program indefinitely to investigate potential violations of The Futon Shop's policies without prior notice to the Eligible Participant. If The Futon Shop in its sole discretion believes an Eligible Participant has or is using existing The Futon Shop accounts or creating new accounts in order to circumvent or undermine these Terms and Conditions, The Futon Shop reserves the right to terminate the Eligible Participant's participation from the Program.
    • 2. To opt out of this Program, please email The Futon Shop and request the account cancellation. By opting out, you forfeit all accumulated Rewards.
  • 2. Restrictions. The Program is void where prohibited and subject to U.S. laws.
  • 3. Combination with Other Programs. The Futon Shop Rewards points may not be combined with Gift Certificates or Coupons.
  • 4. Limitation of Liability. THE FUTON SHOP SHALL NOT BE LIABLE FOR ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY OR DEATH, RESULTING FROM THE PROGRAM. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. RECIPIENTS OF THE PROGRAM AGREE THAT THE FUTON SHOP HAS NOT MADE NOR IS IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE PROGRAM. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE FUTON SHOP DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO WWW.THE FUTON SHOP.COM AND THE FUTON SHOP SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO. THESE TERMS GIVE YOU SPECIFIC LEGAL RIGHTS. The Futon Shop is not responsible for printing or typographical errors in any Program related materials; for stolen, lost, late, misdirected items; or for transactions and/or emails that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with the Program, or process any transaction thereon. If in The Futon Shop's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Program, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Program, The Futon Shop reserves the right at its sole discretion to disqualify any individual connected therewith, to modify or suspend the Program, or to terminate the Program. In all matters relating to the interpretation and application of any rule or phase of this Program, the decision of The Futon Shop shall be final. The Futon Shop reserves the right to cancel, amend or revoke any Program at any time due to reasonable business consideration or circumstances beyond its control. Any attempt by an Eligible Participant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Program is a violation of criminal and civil laws and should such an attempt be made, The Futon Shop reserves the right to revoke any Rewards and seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any web site associated with the Program via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated devices or programs to redeem the Program is prohibited.
  • 5. The waiver by The Futon Shop of a breach of any provision of this Agreement by an Eligible Participant or other individual shall not operate or be construed as a waiver of any other or subsequent or preceding breach by an Eligible Participant or other individual. No waiver by The Futon Shop of any right under the Program shall be construed as a waiver of any other right. The Futon Shop shall not be required to give notice to enforce strict adherence to all terms of the Program.
  • 6. Governing Law. For purchases made at www.thefutonshop.com, these Terms and Conditions and the Program will be interpreted, construed and enforced, and governed in all aspects in accordance with the exclusive jurisdiction and laws of the state of California. Any cause of action arising under or relating to these Terms and Conditions will be brought exclusively in a court in San Francisco County, CA.

How to Earn Rewards Points

  • For every $100 spent earn 1 point
  • 5 points is equal to $1
  • There is a maximum 500 point discount can be applied per order
  • Maximum discount is $100 that can be applied per order
  • Maximum amount of points you can have in your account is 5000
  • Points cannot be applied toward shipping charges
  • Rewards point values are calculated pretax
  • Points used on refunded orders will be returned to account
  • Earn 3 points when you to create a account
  • Earn 5 points to signup for the newsletter
  • Earn 2 points to review a product 6 points per day max, you must have purchased the product
  • Earn 2 points for placing a share on a social networks, 4 points per day max
Points expire after 90 days - They will receive a reminder email - 7 days prior to expiration

Ineligible Items

  • There are no points earned on tax or shipping fees.
  • You cannot spend your points on tax or shipping fees.
  • You do not earn points when spending points.
  • You must have at least 50 points in your account to begin spending points.
